Some Guidelines for New York City Compliance Mandates for Employment Screening

Pam Devata, of the employment law firm Seyfarth Shaw, has published a white paper offering guidelines on the updated New York City compliance mandates for employment screening processes in that city.  It is a most informative document, one that may have significant impact on your hiring process and your disclosure forms.

Earlier this year, the New York City Council passed two laws which place limitations on an employer’s ability to use background checks including credit checks (otherwise known as consumer reports) in employment decisions: the Fair Chance Act (“FCA”) and the Stop Credit Discrimination in Employment Act (“SCDEA”).
